All of inquiry is a mental process from the known to the unknown within the realm of possibility. This process uses the three faculties of perception, conception, and abstraction, all fueled by information. These faculties have corollaries in Science and Philosophy of Religion. It is the thesis of this book that if these faculties are intelligible and reliability in Science, there is no reason to reject them when used in other fields of inquiry.

This paper presents a model for the structure of universal frameworks in logic, mathematics, and physics that are closed to logical conclusion by the mechanism of paradox across a dualism of elements. The prohibition takes different forms defined by the framework of observation inherent to the structure. Forms include either prohibition to conclusion on the logical relationship of internal elements or prohibition to conclusion based on the existence of an element not included in the framework of a first element. The (...) model is applied to logical arguments in philosophy, mathematics, and physics and is initially a geometrical analysis of quantum theory and its application in experiment. Conclusion from the analysis is extended to give insight into the complexity of infinities above the two-dimensional boundary of the model. (shrink)

Develops a logical analysis of dialogue in which two or more parties attempt to advance their own interests. It includes a classification of the major types of dialogues and a discussion of several important informal fallacies.

The finding that women are attracted to men older than themselves whereas men are attracted to relatively younger women has been explained by social psychologists in terms of economic exchange rooted in traditional sex-role norms. An alternative evolutionary model suggests that males and females follow different reproductive strategies, and predicts a more complex relationship between gender and age preferences. In particular, males' preferences for relatively younger females should be minimal during early mating years, but should become more pronounced as the (...) male gets older. Young females are expected to prefer somewhat older males during their early years and to change less as they age. We briefly review relevant theory and present results of six studies testing this prediction. Study 1 finds support for this gender-differentiated prediction in age preferences expressed in personal advertisements. Study 2 supports the prediction with marriage statistics from two U.S. cities. Study 3 examines the cross-generational robustness of the phenomenon, and finds the same pattern in marriage statistics from 1923. Study 4 replicates Study 1 using matrimonial advertisements from two European countries, and from India. Study 5 finds a consistent pattern in marriages recorded from 1913 through 1939 on a small island in the Philippines. Study 6 reveals the same pattern in singles advertisements placed by financially successful American women and men. We consider the limitations of previous normative and evolutionary explanations of age preferences and discuss the advantages of expanding previous models to include the life history perspective. An evolutionarily stable strategy (ESS) may apply to characters expressed across species for predation and feeding, because these characters are conservative. However, the evolution of complex, polymorphic behaviors is more difficult to define as an ESS. Lateralization may be selective for certain simple traits, but lateralization of complex traits is likely the result of coadaptation of otherwise non-lateralized features.

This research explores the making of physical models as a design process where that act of making 'models for'1 design intention is itself a rich field of speculation. These models for design intention are different to the models of design intention as they are less a finished and singular object, and more an instrument for thinking. The aim of this research is to explore the qualities of models for design intention through an engagement with the landscape in order to understand (...) making as a transformative and emergent process of space, time, material, technique, and the role of the observer. Making for design, the model as idea, seeks to both test and provide opportunities for the convergence of forces and relationships to be created and emergent. Fundamental to this notion is an understanding that the act of making is itself a continual re-making process. The reciprocity invoked by this action engages a rich field of criteria which are potent because of their schizophrenic nature. This paper will discuss my research through a number of projects and esquisses that have been explored during the course of this research which demonstrate the development of my position of making as a continual re-making of space. In this response to Robert Hudson’s article, “Should We Strive to Make Science Bias-Free? A Philosophical Assessment of the Reproducibility Crisis,” we identify three ways in which he misrepresents our work: he conflates value-ladenness with bias; he describes our view as one in which values are the same as evidential factors; and he creates a false dichotomy between two ways that values could be considered in science for policy. We share Hudson’s concerns about promoting scientific reproducibility and reducing bias in (...) science, but we reject his view that the value-free ideal provides helpful guidance for addressing these issues. This article presents a philosophical framework for physician-family ethical decision-making for the controversial cases of withdrawal, initiation, or continuation of treatment for spina bifida infants. The well-known criteria for selective treatment proposed by Lorber are shown to be ethically sub-optimal on the grounds that they are based on a general conception of the decision framework that is open to serious criticisms and questioning.We propose a model of joint physician-family decision-making that we think represents a more rational method of balancing patient (...) autonomy with the professional expertise and international moral norms of physicians. We raise serious reservations about the wisdom of allowing the state to intervene too strenously in this type of decision, in many cases. (shrink)

According to the Supreme Court of Canada, Aboriginal title is a property right, albeit of a distinctive kind. Most significantly, the right is subject to an inherent limit: title lands cannot be used in a way that deprives present and future generations of the right to use the land. Aboriginal title is also encumbered by a restraint on alienation, and has its source in Aboriginal legal systems that predate and survive the assertion of Crown sovereignty. In this paper, we argue (...) that these features of Aboriginal title are not burdensome judicial innovations on a property right, but are instead the essential contours of a sovereign right. That is, the Court’s own description of Aboriginal title does not comport with sound theoretical understandings of a property right. Aboriginal title is much more akin to a right of sovereignty—the right to make laws about the use of a territory. Aboriginal title is the right of law-making jurisdiction over the title lands. The existing literature, while edging towards the view that Aboriginal title is a sovereign right, has lacked the unifying theoretical basis needed to decisively dispatch the Court’s property paradigm. In particular, all extant accounts find the inherent limit inexplicable. The account in this article theorizes and explains the inherent limit, as well as all of the sui generis elements of Aboriginal title, and shows their interconnectedness. Our view additionally answers a number of questions that the Court’s property paradigm does not, including: (1) what laws primarily govern title lands; (2) who has standing to question whether any particular use of title land violates the inherent limit; (3) what is the status of private land interests that overlap with Aboriginal title lands; and (4) how should the doctrine of Aboriginal title be updated in light of jurisprudential developments emphasizing that Indigenous peoples never ceded their sovereignty?
